ACCEPTABLE USE POLICY

Welcome to Hype Nest Global (“Company,” “we,” “our,” or “us”).

This Acceptable Use Policy (“AUP” or “Policy”) governs access to and use of all products, platforms, software, websites, applications, AI systems, automation tools, APIs, consulting deliverables, and related services (collectively, the “Services”) provided by Hype Nest Global, a company with its head office in Bengaluru, Karnataka, India (“Hype Nest Global,” “Company,” “we,” “us,” or “our”).

This Policy applies to every individual, business, or entity that accesses or uses the Services (“Customer,” “Client,” “you,” or “your”), including authorized users, employees, contractors, agents, and end users interacting with Customer-deployed AI agents or automations powered by the Services. This Policy forms part of the Agreement with Hype Nest Global and should be read with our Terms and Conditions, Privacy Policy, AI Usage Policy, and any applicable Order Form or Statement of Work.

By using the Services, you agree to comply with this Policy. Hype Nest Global reserves the right to investigate violations and to suspend or terminate access immediately for violations, suspected abuse, or legal risk.

1. PURPOSE AND SCOPE

1.1 The purpose of this Policy is to protect Hype Nest Global, its customers, end users, infrastructure, partners, and the public from harmful, unlawful, abusive, or high-risk use of the Services.

1.2 This Policy applies to use of the Services worldwide, including use through websites, dashboards, APIs, integrations, white-label deployments, and Customer-facing AI agents configured using Hype Nest Global technology.

1.3 Customer is responsible for ensuring that all Users and any third parties Customer permits to interact with the Services comply with this Policy.


 

2. DEFINITIONS

2.1 “AI Output” means content or actions generated in whole or in part by AI models, agents, or automation logic within the Services.

2.2 “Harmful Content” means content that is unlawful, deceptive, abusive, violent, exploitative, or otherwise prohibited under this Policy.

2.3 “High-Risk Activity” means use cases involving life-critical systems, clinical diagnosis, emergency response, autonomous weapons, large-scale surveillance without lawful basis, or similar activities with elevated potential for serious harm.

2.4 “Services” means all offerings of Hype Nest Global as defined above.

2.5 “User” means any person authorized by Customer to access the Services, and, where context requires, any end user interacting with Customer systems built on the Services.

2.6 “Violation” means any act or omission that breaches this Policy, the Agreement, or applicable law in connection with the Services.


 

3. PERMITTED USES

3.1 Customer may use the Services solely for lawful business purposes consistent with the Agreement, Documentation, and applicable law.

3.2 Permitted uses include, without limitation:

(a) operating AI agents, chatbots, and voice systems for legitimate customer support, sales assistance, appointment scheduling, and internal productivity, subject to disclosure and human oversight requirements;
(b) building and operating workflow automation, CRM/ERP integrations, and business process automation;
(c) developing, hosting, and maintaining custom software, websites, and applications under an authorized engagement;
(d) using analytics, market research, and business intelligence tools for lawful organizational decision support;
(e) configuring integrations with authorized Third-Party Services for which Customer holds valid accounts and licenses; and
(f) accessing APIs within documented rate limits and authentication controls.

3.3 Customer must use the Services in a manner that respects the rights of individuals, protects personal data, and maintains appropriate security and human review for material decisions.


 

4. PROHIBITED ACTIVITIES — GENERAL

4.1 Customer shall not, and shall not permit others to, use the Services to engage in any activity that is unlawful, harmful, fraudulent, infringing, abusive, or contrary to this Policy.

4.2 Prohibited activities include the specific categories set out in Sections 5 through 22. The lists are illustrative and not exhaustive. Hype Nest Global may treat analogous conduct as a Violation.


 

5. ILLEGAL ACTIVITIES

5.1 Customer shall not use the Services to:

(a) violate any applicable local, state, national, or international law or regulation;
(b) facilitate crime, terrorism, human trafficking, exploitation, or money laundering;
(c) evade sanctions, export controls, or trade restrictions;
(d) distribute controlled substances unlawfully; or
(e) assist in the planning or commission of violent crime or other serious offenses.

5.2 Customer is solely responsible for determining whether a particular use case is lawful in Customer’s industry and jurisdictions.


 

6. FRAUD AND DECEPTIVE PRACTICES

6.1 Customer shall not use the Services to:

(a) commit fraud, phishing, social engineering, or identity theft;
(b) create fake accounts, fake reviews, or deceptive lead-generation schemes;
(c) misrepresent affiliation with Hype Nest Global or any third party;
(d) operate advance-fee scams, investment scams, or similar deceptive schemes; or
(e) manipulate billing, usage metering, trials, or promotional programs.

6.2 Use of AI agents to impersonate humans in a manner intended to deceive, where disclosure is legally required or reasonably expected, is prohibited unless Customer provides legally compliant disclosure and obtains any required consents.


 

7. SPAM AND UNWANTED COMMUNICATIONS

7.1 Customer shall not use the Services to send spam or unsolicited bulk communications via email, SMS, WhatsApp, voice calls, or other channels in violation of applicable anti-spam, telemarketing, or electronic communications laws.

7.2 Customer must obtain all required consents and maintain lawful opt-out mechanisms for marketing and automated outreach.

7.3 Customer shall not use purchased, scraped, or otherwise unlawfully obtained contact lists in connection with the Services.

7.4 Excessive or abusive messaging that degrades platform reputation, triggers carrier blocks, or violates WhatsApp Business, Twilio, or similar provider policies is prohibited.


 

8. MALWARE AND HOSTILE CODE

8.1 Customer shall not upload, transmit, distribute, or execute malware, ransomware, trojans, viruses, worms, spyware, keyloggers, or other hostile code through or against the Services.

8.2 Customer shall not use the Services to develop, test, or distribute attack tooling intended for unauthorized intrusion, except in authorized security research environments expressly approved in writing by Hype Nest Global.


 

9. HACKING AND UNAUTHORIZED ACCESS

9.1 Customer shall not:

(a) attempt to gain unauthorized access to the Services, related systems, accounts, or data;
(b) probe, scan, or test the vulnerability of any system or network without prior written authorization;
(c) breach, bypass, or circumvent authentication, encryption, rate limits, or other security controls;
(d) access another customer’s data or workspace without authorization; or
(e) exploit zero-day or known vulnerabilities against Hype Nest Global infrastructure.

9.2 Credential sharing beyond licensed seat counts, password stuffing, and credential stuffing are prohibited.


 

10. REVERSE ENGINEERING

10.1 Customer shall not reverse engineer, decompile, disassemble, translate, or otherwise attempt to derive source code, model weights, prompts, system instructions, architectures, or trade secrets underlying the Services, except to the limited extent such restriction is prohibited by applicable law.

10.2 Customer shall not use the Services to build a directly competing product by systematically extracting features, workflows, prompts, or non-public technical details.


 

11. INTELLECTUAL PROPERTY INFRINGEMENT

11.1 Customer shall not use the Services to infringe copyrights, trademarks, trade secrets, patents, moral rights, publicity rights, or other intellectual property or proprietary rights.

11.2 Customer shall not upload or generate content that Customer does not have rights to use, and shall not remove proprietary notices from the Services or Deliverables.

11.3 Customer shall respond promptly to valid infringement notices relating to Customer Content or Customer-deployed systems.


 

12. ABUSE OF AI SYSTEMS

12.1 Customer shall not use AI Services to:

(a) generate disinformation campaigns, deepfakes, or non-consensual synthetic media intended to harm, defraud, or deceive;
(b) automate decisions with legal or similarly significant effects without appropriate human oversight and lawful basis;
(c) generate content that enables cyberattacks, biological or chemical harm, or other severe safety risks;
(d) manipulate model behavior to evade safety filters for prohibited ends; or
(e) misrepresent AI Output as solely human-authored where disclosure is legally required.

12.2 Customer must comply with the AI Usage Policy, including human review requirements for high-stakes contexts.


 

13. AUTOMATED SCRAPING AND DATA EXTRACTION

13.1 Customer shall not use bots, crawlers, scrapers, or similar automated means to harvest, extract, or index data from the Services beyond what is expressly permitted through documented APIs and rate limits.

13.2 Customer shall not systematically copy Documentation, knowledge bases, prompt libraries, or non-public datasets from the Services.

13.3 API access must use assigned credentials, respect rate limits, and not attempt to obfuscate identity or origin.


 

14. UNAUTHORIZED ACCESS TO ACCOUNTS AND KEYS

14.1 Customer must safeguard login credentials, API keys, access tokens, webhooks, and secrets.

14.2 Customer shall not share credentials in a manner that circumvents licensing, seat limits, or security controls.

14.3 Customer must notify Hype Nest Global immediately of suspected unauthorized access, key leakage, or account compromise.

14.4 Hype Nest Global may revoke compromised credentials and require remediation as a condition of restored access.


 

15. EXCESSIVE API USAGE AND RESOURCE ABUSE

15.1 Customer shall not intentionally overload, flood, or disrupt the Services, including through denial-of-service techniques, runaway automation loops, or abusive concurrency.

15.2 Usage materially exceeding purchased plans, fair-use expectations, or documented limits without upgrade or written approval may be throttled, suspended, or billed as overage.

15.3 Customer shall not resell, sublicense, or provide bureau access to the Services without prior written consent, except under an authorized reseller or white-label arrangement.


 

16. SECURITY VIOLATIONS

16.1 Customer shall not interfere with logging, monitoring, audit trails, or security features of the Services.

16.2 Customer shall not introduce insecure configurations that foreseeably expose Hype Nest Global systems or other customers to material risk.

16.3 Customer must promptly apply security recommendations reasonably communicated by Hype Nest Global where Customer’s configuration creates elevated risk.


 

17. HARASSMENT

17.1 Customer shall not use the Services to harass, threaten, stalk, intimidate, defame, or abuse any person or group.

17.2 Customer shall not deploy AI agents to engage in abusive outreach, targeted harassment, or coercive communications.


 

18. HATE SPEECH AND DISCRIMINATION

18.1 Customer shall not use the Services to generate or disseminate content that promotes hatred, violence, or unlawful discrimination based on protected characteristics under applicable law, including race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, or age.

18.2 This Section does not prohibit legitimate discussion, journalism, education, or satire that does not constitute advocacy of hate or violence, but Hype Nest Global retains discretion to determine whether content crosses into prohibited Harmful Content.


 

19. HARMFUL AND ILLEGAL CONTENT

19.1 Customer shall not generate, store, transmit, or distribute through the Services content that is:

(a) obscene in a manner prohibited by law;
(b) pornographic content involving minors, or any sexual content involving anyone seventeen (17) years of age or younger, which is strictly prohibited;
(c) content that promotes self-harm in a manner intended to encourage harm;
(d) content that provides practical assistance for violent crimes or severe wrongdoing; or
(e) content that violates privacy rights, including doxxing.

19.2 Customer shall implement reasonable content moderation and escalation controls for public-facing AI agents.


 

20. CHILD SAFETY

20.1 The Services may not be used to create, possess, distribute, solicit, or advertise child sexual abuse material or any content that sexualizes minors.

20.2 Customer shall not use the Services to groom, exploit, or endanger children.

20.3 Hype Nest Global will report apparent child sexual exploitation material to appropriate authorities as required by law and may preserve related data for law enforcement.

20.4 Users must be at least eighteen (18) years of age, or the age of legal majority, to enter into agreements for the Services. Customer systems directed to children must comply with applicable child protection and privacy laws.


 

21. IMPERSONATION

21.1 Customer shall not impersonate any person, brand, public figure, government authority, or entity in a misleading or unlawful manner.

21.2 AI voice cloning, likeness synthesis, or chatbot impersonation requires lawful basis, necessary consents, and compliant disclosure. Non-consensual impersonation intended to deceive or harm is prohibited.


 

22. CRYPTOCURRENCY ABUSE AND FINANCIAL MISUSE

22.1 Customer shall not use the Services to operate unlicensed money transmission, unlawful crypto schemes, pump-and-dump promotions, rug-pull facilitation, or investment fraud.

22.2 Customer shall not use the Services to launder proceeds of crime or to obscure beneficial ownership in violation of AML laws.

22.3 Legitimate fintech, payments, or crypto-related business use is permitted only where Customer holds all required licenses and complies with applicable financial regulations. Hype Nest Global does not provide money transmission services.


 

23. HIGH-RISK ACTIVITIES

23.1 Customer shall not use the Services in life-critical or safety-critical systems—including medical diagnosis, emergency dispatch, autonomous weapons, aviation, nuclear, or industrial safety control—without Hype Nest Global’s prior written authorization and documented risk controls.

23.2 Even where authorized, Customer remains solely responsible for regulatory compliance, clinical or safety validation, and human oversight.

23.3 Use of the Services for biometric categorization, real-time remote biometric identification, or social scoring in ways prohibited by applicable AI or privacy law is forbidden.


 

24. CUSTOMER RESPONSIBILITIES

24.1 Customer shall:

(a) configure and supervise Users appropriately;
(b) maintain lawful bases and consents for personal data processing;
(c) implement human review for high-stakes AI Output;
(d) monitor public-facing agents for misuse;
(e) keep integrations and credentials secure; and
(f) cooperate with reasonable investigations by Hype Nest Global.

24.2 Customer is liable for Violations by its Users and for Harmful Content submitted or generated through Customer’s accounts and deployments.


 

25. SUSPENSION

25.1 Hype Nest Global may suspend all or part of Customer’s access immediately, with notice where reasonably practicable, if Hype Nest Global reasonably determines that:

(a) a Violation has occurred or is likely;
(b) Customer’s use poses a security, legal, or operational risk;
(c) suspension is required by law, regulator, or infrastructure provider; or
(d) continued provision would expose Hype Nest Global to material liability.

25.2 Suspension may include disabling AI agents, API keys, workspaces, websites, automations, and support access.

25.3 Suspension does not relieve Customer of payment obligations for amounts already due, except as required by mandatory law.


 

26. INVESTIGATION

26.1 Hype Nest Global may investigate suspected Violations using logs, usage records, content samples, customer reports, and information from partners or authorities.

26.2 Customer agrees to provide reasonable cooperation, including relevant context, user identity information where lawful, and remediation plans.

26.3 Hype Nest Global may preserve data relevant to an investigation and disclose information to law enforcement or regulators where required or permitted by law.

26.4 Investigations may be conducted without prior notice where notice would compromise security or legal process.


 

27. REPORTING VIOLATIONS

27.1 To report a suspected Violation, contact: joydip@hypenestglobal.com with the subject line “AUP Violation Report.”

27.2 Reports should include, where available: affected URLs or agent identifiers, timestamps, description of the conduct, supporting evidence, and reporter contact details.

27.3 Hype Nest Global will review reports in good faith but does not guarantee a particular outcome or response timeline, except where mandated by law.

27.4 Good-faith reporters acting lawfully will not be retaliated against for submitting a report. Knowingly false reports may themselves constitute a Violation.


 

28. ENFORCEMENT

28.1 Enforcement actions may include, without limitation:

(a) warnings;
(b) mandatory corrective actions;
(c) content removal or agent disablement;
(d) rate limiting or feature restriction;
(e) suspension;
(f) termination;
(g) denial of future service; and
(h) pursuit of legal remedies, damages, and injunctive relief.

28.2 Hype Nest Global may choose the enforcement measure it reasonably considers proportionate to the severity, intent, recurrence, and risk of the Violation.

28.3 Hype Nest Global’s failure to enforce this Policy in one instance does not waive enforcement in another.


 

29. APPEALS

29.1 Customer may appeal a suspension or termination by emailing joydip@hypenestglobal.com within fifteen (15) days of notice, with the subject line “AUP Appeal,” including account details, the action appealed, and supporting information.

29.2 Hype Nest Global will review appeals in good faith and may uphold, modify, or reverse the action. Decisions following appeal review are final as between the parties, without prejudice to mandatory legal rights.

29.3 Access may remain suspended during appeal review.


 

30. TERMINATION

30.1 Serious, repeated, or unremediated Violations entitle Hype Nest Global to terminate the Agreement or affected Services immediately without further cure opportunity, in addition to any other remedies.

30.2 Upon termination for Violation:

(a) licenses and access cease;
(b) prepaid fees are non-refundable except as required by mandatory law;
(c) Customer remains liable for outstanding amounts; and
(d) Hype Nest Global may delete or disable Customer Content associated with the Violation, subject to legal retention obligations.

30.3 Provisions that by nature should survive, including confidentiality, IP, indemnity, and liability limitations, continue to apply.


 

31. RELATIONSHIP TO THIRD-PARTY POLICIES

31.1 Use of integrated Third-Party Services remains subject to those providers’ acceptable use and content policies. A Violation of a critical third-party policy that affects Hype Nest Global may be treated as a Violation of this Policy.

31.2 Hype Nest Global is not responsible for enforcement decisions of third-party providers but may take parallel action to protect the Services.


 

32. UPDATES

32.1 Hype Nest Global may update this Policy to reflect legal, technical, or risk developments. Material updates will be notified via website, email, or in-product notice.

32.2 Continued use after the effective date constitutes acceptance of the updated Policy.

34. GOVERNING LAW

This Policy is governed by the laws of India, subject to mandatory local laws where applicable, and to the dispute resolution provisions of the Terms and Conditions.


 

35. INDUSTRY-SPECIFIC RESTRICTIONS

35.1 Healthcare Customers shall not use the Services to provide clinical diagnosis, prescribe treatment, or operate as a medical device without required regulatory clearances and Hype Nest Global’s prior written authorization.

35.2 Financial services Customers shall not use the Services to provide regulated investment advice, execute unauthorized money transmission, or violate applicable securities, banking, or payments laws.

35.3 Education Customers shall protect student data and comply with applicable education privacy laws when using AI agents or automation with learners.

35.4 Agency and reseller Customers remain responsible for end-client compliance with this Policy and may not permit end clients to use the Services in ways Customer itself is prohibited from doing.


 

36. WHATSAPP, SMS, EMAIL, AND VOICE CHANNEL RULES

36.1 Customer shall comply with WhatsApp Business Platform policies, Twilio acceptable use rules, carrier requirements, and applicable telemarketing and anti-spam laws for all outreach conducted through the Services.

36.2 Customer must honor opt-outs promptly and maintain proof of consent where required.

36.3 Spoofing caller ID, forging sender identities, or using lookalike domains to deceive recipients is prohibited.

36.4 High-volume messaging that triggers spam classifications may be throttled or suspended even if Customer believes consent exists, pending verification.


 

37. DATA MINING AND COMPETITIVE INTELLIGENCE ABUSE

37.1 Customer shall not use the Services to systematically collect personal data for sale, unlawful profiling, or unsolicited marketing lists.

37.2 Customer shall not use AI agents to scrape third-party websites in violation of those sites’ terms, robots directives, or applicable law.

37.3 Competitive benchmarking that involves unauthorized access, credential misuse, or extraction of non-public Hype Nest Global materials is prohibited.


 

38. ACCOUNT SHARING AND SEAT ABUSE

38.1 Named-user licenses may not be shared among multiple concurrent individuals beyond the purchased seat count.

38.2 Customer shall not create multiple trial accounts to evade fees or usage limits.

38.3 Automated account creation, fake identities for registration, or use of disposable credentials to abuse promotions is prohibited.


 

39. COOPERATION WITH AUTHORITIES

39.1 Hype Nest Global may cooperate with law enforcement, regulators, and courts in response to valid legal process.

39.2 Where legally permitted, Hype Nest Global may notify Customer of such requests, except where notice is prohibited or would risk harm, obstruction, or compromise of an investigation.


 

40. NO WAIVER OF OTHER REMEDIES

40.1 Enforcement under this Policy is in addition to rights under the Terms and Conditions, Acceptable Use provisions in Order Forms, and remedies available at law or equity.

40.2 Suspension or termination does not limit Hype Nest Global’s right to seek damages, injunctive relief, or recovery of costs.


 

41. SEVERABILITY

If any provision of this Policy is held unenforceable, the remaining provisions continue in full force, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving intent.


 

42. ENTIRE AUP FRAMEWORK

This Policy, together with the Terms and Conditions and AI Usage Policy, constitutes the acceptable use framework for the Services. In case of conflict on usage restrictions, the more protective restriction for Hype Nest Global, its customers, and the public shall apply unless mandatory law requires otherwise.

BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS ACCEPTABLE USE POLICY. HYPE NEST GLOBAL MAY SUSPEND OR TERMINATE ACCESS IMMEDIATELY FOR VIOLATIONS.
